A question about : Visit From Debt Collector (Resolvecall) Today, What Should I Do Now?

I had a letter from a company called Resolvecall the other week threatening me with a doorstep visit if I didn't contact them in regards to a loan I had with Northern Rock (this has been passed through various DCAs over time). I followed advice from other forums and just ignored them thinking that it was an empty threat. However, this morning there was a knock at the door (thought it was the postie and as I'd just got out of the shower I didn't answer.) Anyway, there was a brown envelope on the floor with my name handwritten on it and inside is a card that says I need to urgently call them and they'd called today for the 1st time regarding your account. There's then a number to call and a ref number to quote.

What can I do to stop these people coming round? The problem is that it's my parents house that they are visiting as that's where I am living at the moment.

What should I do next? Please help!

Best answers:

  • Write to them removing their right of implied access and point out that they can only turn up if you make an appointment with them (which you wont be doing)
  • post 2 is the correct advice
  • If you ever *have* to deal with a scumbag DCA, always do it in writing. I use crayons sometimes as its about the best they can understand.
  • While I'm no fan of Mr Jones, he does have one underlying point... the debt is probably not going away for a while.
When did you last make a payment to the loan/ when did it default?
My feeling is if you have a while left before the debt becomes more or less unenforceable, you can play 'avoid the debt collectors' but it does get boring & stressful and they will find you. If you only have a few months to go you may consider this option, but if you have years I'd be looking for another approach.
The other option is to communicate with them and to set a repayment amount you can afford (after having done an SOA) - this is not a priority debt. Or save up and offer them a full and final settlement. If you do intend to deal with them, as everyone says doing it in writing seems to be the way forward!
Debt collectors are just trying to collect money. They don't have any personal vendetta against you. they will sometimes mislead you so it's best to negotiate in writing so they can't tell you things they then go back on!
  • If you are the same person that posted on CAG today, you have an outstanding CCA request with a previous creditor.
I am going to assume that you are the same person.
Resolvecall will not know the history. You should make them aware and tell them that you dispute their legal right to demand payment, or take any other collection activity.
  • I am no fan of DCA`s either, but turning up at your door is pretty far down the collection process route, just ignoring them does not always make them go away, and could lead to a CCJ by default.
If you have a genuine dispute, then tell them, if you are awaiting a CCA request, tell them that.
The key to dealing with a DCA is communication, no matter what it might be, if you dispute any part of what there telling you, tell them you dispute it, if you don't want them knocking on your door, again, tell them, but remember always do it in writing.
Only sure way to get them to cease collection activity is to set up a payment plan, but make sure all disputes are settled first.
  • Got to say if a dca are sending someone to your door then you must have been ignoring them for some time. Dca's aren't known for usually following through with their threats of doorstop activity unless the debt is enough to justify a visit or they have irrefutable proof you owe the debt and it's not going anywhere for a while.
That said, these doorstop collectors have about as much right to entry of any property as the postman. Only a court appointed bailif can enter a property without consent, and they need a lot of paperwork from the courts to action this.
If this person visits again either tell them to get their dca to write to you or step out of the front door, closing it behind you, to discuss matters with them on your porch. Ensure no windows or other doors are easy to access for them. Fi d out what they want, and tell them you'll be contacting the dca to arrange a payment plan if they have the documentation necessary, I.e CCA and proof of the debt.
