A question about : Old cahoot now santander loan f&f

Hello everyone,

I'm finally getting around to trying to pay off my overdue loans and debts.I'll probably be posting a few questions over the next few weeks if I can't find an answer already. What a great place for help!

First, I have an old flexi loan from Cahoot that is now in default withSantander. I have not paid this loan for about 2 years. (Sadly I think it's nowtoo late to ask for the interest refund like so many have done.)

I have received a statement from Santander but no request to pay. However, Capquestand Moorcroft have both sent letters asking for payment. The last one dated Maythis year. But they only say the debt has been referred to andinstructed by and not sold to them.

1. My question is who do I deal with? I would like to send a cca request totry and get a full and final offer to settle.

2. Also, I have another debt that has been sold to Capquest. Is there anychance to combine a full and final? Do they deal with them separately?

3. I've looked on my credit report with Experian and Equfax. Not every debtseems to be on there. Is there another credit report agency I should look at?If it is not on there is it gone!? :O

4. On my credit file there is a debt to Capquest. (Bank Default from Capquest Investments Limited 2 (I))I have never had any agreement / contact with them - how can they create an entry!?

    You should complain about the interest rates. You will be rejected by them and FOS but court action against Santander is being looked into, as detailed on the loans bard thread. It might be important that the complaints procedure has been exhausted if anything comes of this court action.
    To answer your questions:
    1. Either, the last folk that write to you or Santander. If Satander don't wish to talk to you they will tell you who to contact. DCA would likely need to ask Satander for it anyhow.
    When was the loan taken out? They had my agreement from early 2000s. Signed and all, but on closer inspection its unenforceable, as many were. Best bet for reduced F and F is if they can't find it at all.
    2. Possibly, but best deal with them separately so you have an independent paper trail for each. Get any F and F in writing first.
    3. Try Noddle. It's free. Did any debts default a while ago? Stay 6 years from default date. May also have been sold and the new owner hasn't logged them yet.
    4. You said Capquest have your accounts? When sold, often the DCA takes responsibility for updating your credit report for the account they bought.

    The old Cahoot flexi loan was taken out in Jan 2004 I think.What do I have to look for - Why are they unenforceable?
    I'm going to send off for my CCAs to only the people on my credit reports. I don't want to wake sleeping dragons.
    It seems that I can't access Noddle from outside the UK. I'm in Spain now.

  • Spain should prevent them knocking on your door then
    The unenforceable bit is complicated, but in CCA speak the prescribed terms are wrong. Can't assume they will be on yours but a reasonable chance. Report back when you get your CCA and ill point you in the right direction if you need its
    Best bet is if no one can find it as they are much more likely to accept reduced final offer.
  • I've managed to see my credit report from callcredit and interestingly it has one debt that is not shown on Equifax or Experian.

  • I'm sending them to four - two with Lowell, one with Capquest and one direct to Santander.
    However, I've also got letters from Capquest and Moorcroft asking about the Santander. Who is the best to deal with do you think? My credit file still says Santander has the loan.
  • I would always send a letter to the last company that contacts me about the account. If they don't have the documents, its their job to get them from whoever has them.
